In consideration of the fee paid participant understands that there is a risk of personal injury in the course of martial arts instruction (including but not limited to sparring, practice/drilling, and competition) and, with this knowledge, agrees to assume the risk of any injury and damages to the participant during the seminar.

Specifically, the participant agrees to hold harmless Arsenal Combat Sports Club LLC  and all other individuals, organizations, sponsors, partners, promoters, operators, hosts, instructors, associations, schools, owners, officials, directors, employees, and other participants connected with the event from all losses, damages, injuries, causes of actions, claims, or complaints in the event that the participant is damaged or injured in any way during the participation, instruction and/or performance of any exercise or during any activity associated with the event location or during transit to or from the event.

Participant further agrees to strictly obey instructors and observe safety rules.

Because of the physical demands of martial arts and/or personal defense instruction participant understands that he/she must be in good physical condition to participate in the event. Participant understands that in case of injury, the only medical treatment Arsenal Brazilian Jiu-Jitsu will provide is first aid.

Participant agrees that any pictures, audio, or visual recordings taken of him/her in connection with the seminar, regular classes, and special events can be used for publication, promotion, articles, shows and advertisement without additional consent and without compensation at this time or any other time.

I have read and understood this release and agreement and agree to its provisions. I am not under their influence of any drugs, alcohol, or other intoxicants. I am not suffering from any illness or incapacity. I am over 18 years of age. (If not over 18 years of age, parent or guardian must sign.)

I agree that I am personally responsible for my safety and actions while training at Arsenal Brazilian Jiu-jitsu in Huntsville, Al (Herein referred to as "The Gym"). I agree to comply with all The gyms policies and rules, including but not limited to all the gyms policies, guidelines, signage, and instructions. Because the gym is open for use by other individuals, I recognize that I am at higher risk of contracting COVID-19.

With full awareness and appreciation of the risks involved, I, for myself and on behalf of my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, hereby forever release, waive, discharge, and covenant not to sue the gym, Freeman Consultants LLC, its board members, officers, agents, servants, independent contractors, affiliates, employees, successors, owners and assigns (herein referred to as the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties, any third-party using the gym, or otherwise while participating in any activity while in, on, or around the gym and/or while using any Arsenal BJJ facilities, tools, equipment, or materials.

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my use of the gym facilities, tools, equipment, or materials, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.

I acknowledge and represent that I have read the foregoing Waiver of Liability, understand it and sign it voluntarily as my own free act and deed, including without limitation the Release of Liability and Indemnification requirements contained in this document; I am sufficiently informed about the risks involved in using the gym to decide whether to sign this document; no oral representations, statements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this document for full, adequate, and complete consideration fully intending to be bound by the same.

I agree that this Wavier of Liability shall be governed by and construed in accordance with Alabama law and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Wavier of Liability as a whole. This waiver remains in effect until the State of Alabama lifts all COVID-19 related mandates.
