As of ,[Date] stated above, the signer hereafter referred to as “Client”, enters into the following agreement with Bakin' Jakes Photography (Jacob King), hereafter referred to as “Photographer.” This contract constitutes the entire agreement between both parties and will apply to all future transactions.

Session Fee & Retainer Fee:

Client agrees to pay photographer the non-refundable retainer fee/ session fee at the time of booking for a 1 hour Video/Photography Session. The fees cover the time and talent of the photographer, basic lightroom retouching and creative real-life editing of images as determined by the photographer and a gallery of images/videos. Photoshop retouching will be a extra fee of $30 per image for any cloning out/removing a subject, color retouching/change, or adding anything to the image or video.

Location Cost & Travel Fees:

If there are any cost and/or fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange any payments on any location. This fee will be discussed about before the time of the session and covers travel within 1 hour of your chosen location from Clinton Township. Any location outside of these limits will be subject to an additional charge or $.50 per mile as part of the agreement.

Cancelation Policy:

If an illness or situation prevents a photo session from taking place, client may reschedule at least 24 hours prior to their scheduled shoot without penalty. Should client fail to give 24 hours’ notice, or decide to completely cancel their shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction or other circumstances beyond their control.

Photo/Video Archiving:

All images/videos will be available for purchase and/or download for 4 weeks following the session date. After 4 weeks, images may be purged from the hard drive and no longer available for access. Photographer may retain certain images/videos for promotional purposes. Photographer is not responsible for storing images/videos beyond the 4-week period.

Photography Session Services Payment:

All payments must be paid in full the day before the session in order for photos to be taken.

Model Release:

Photographer requires clients to sign a model release for the purpose of using images for future marketing purposes or for display in their portfolio whether in print or online. I agree to grant the following rights and permissions to Bakin' Jakes Photography (Jacob King) who have the irrevocable, perpetual and unrestricted right and permission to take, use, re-use, publish, and republish photographic portraits or pictures/videos of me/my family or in which I may be included, without restriction as to changes or alterations or reproductions thereof in color or otherwise and in any and all media now or hereafter known, specifically including but not limited to print, media, and distribution over the internet for illustration, promotion, art, editorial, advertising, trade, or any other purpose. I hereby attest that I have the right to contract in my own name. I have read the above authorization, release, and agreement, prior to its execution and I am fully familiar with the contents of this document. 

Damages:

Client will be held accountable for any damages/medical bills that may occur to any/all Bakin' Jakes Photography equipment, staff, and self caused by client, clients' Pet(s), or Children(s).

Liability:

Photographer is not responsible for any damage to person(s) or property during photo session. Client is responsible for their own children/pets and their safety at all times. Client releases Photographer of any and all liability.

Copyright:

Bakin' Jakes Photography (Jacob King) retains all copyrights to all images created during client’s session. A print release will be signed for all digital files to print portraits for personal use, up to designated size listed on print release. It is illegal to copy, scan, download, print, share or alter any image created by Bakin' Jakes Photography (Jacob King) unless permission has been given in a written form. Indemnification Client agrees to indemnify and hold harmless the Photographer from any claims, losses, fees, attorney fee, cost and judgements against the Photographer that result from acts or omission of the client, clients family members or any acting agent of the client. The images that are being provided to you are licensed copies for any reasonable personal purposes, including but not limited to: printing, copying, emailing, and web publishing (web publishing requires use of watermarked copy of image/video provided by Bakin' Jakes Photography (Jacob King)). Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature. Your purchase of the edited files releases Bakin' Jakes Photography (Jacob King) from any liability due to loss or damage of the images, and also releases Bakin' Jakes Photography (Jacob King) from any obligation to maintain copies of any digital file, video, image, or photograph. You hereby grant to Bakin' Jakes Photography (Jacob King) the right to use and publish images, videos and photographs taken at your photography/videography session to further promote its service, including portfolio, web site, display, advertisement, and editorial use. Bakin' Jakes Photography (Jacob King) agrees to limit the use of these images and photographs to promotional use only. Bakin' Jakes Photography (Jacob King) may revoke this license at any time and for any reason. Bakin' Jakes Photography (Jacob King) retains all copyrights to the images and derivative works thereof. Client agrees not to reproduce or modify the images or footage provided by Bakin' Jakes Photography (Jacob King) without first obtaining a formal written release signed by Bakin' Jakes Photography (Jacob King). Should Bakin' Jakes Photography (Jacob King) discover any violations to this agreement, Client agrees to be held financially responsible at a rate of $300 per violation.

Boudoir/Sexual Harrasment:

Client agrees that for any and all Boudoir sessions they must come showered, groomed, and properly upkept (deodorant, gum, etc) before entering the studio. Any sexual, suggestive, or phycial/verbal advances towards the photographer, staff/clients or other models will result in temination of contract and immediately removed from the premises and police called. 

Cannabis/Alcohol Usasage:

Client agrees that themselfs are over 21+ to use Cannabis/Alcohol legally in Michigan per State Laws; (for Cannabis/Alcohol related video/photoshoots only).
