LIABILITY RELEASE AND TRAINING AGREEMENT 1. I agree that I have voluntarily hired Mindful Canine to assist me in training my dog(s). I understand it is my responsibility to clearly communicate my wishes and expectations to my trainer. I agree that Mindful Canine staff, as training professionals, determine which strategies and tools are necessary to help me train my dog(s). I understand that I will obtain the best training results by following the instructions of the Mindful Canine trainer, and that I am solely responsible for the training of my dog(s). I understand that I will be assigned work outside of sessions with a trainer and I have a responsibility to follow through with the assignments, and that failure to do so may compromise my dogs’ progress in training. 2. I attest that any dog I enroll in Mindful Canine Training is in good health, does not have a confirmed or suspected parvovirus infection, is free from all parasites, and has received all required vaccinations required by the State of Utah and recommended by my vet. I agree that I am obligated ongoing to report to Mindful Canine any signs of illness or infection in my dog(s). 3. In the event of an emergency where a Mindful Canine Trainer is working with my dog(s) and I am not present, I grant Mindful Canine, in its sole discretion, permission to seek out professional veterinary attention/care for my dog(s) at my own expense. I understand that I will be contacted immediately in the event of an emergency through the phone number(s) I provide. 4. I agree that dogs, as animals, may engage in or display behavior that may be aversive or dangerous to other animals or people. I agree that Mindful Canine may use “corrections” to interrupt and/or cease my dogs’ inappropriate behavior in the best interests of my own dog(s) and the safety of other animals and people. Such corrections include, but are not limited to emergency handling techniques, fair and quick leash corrections/pressure, verbal feedback, and proportional ecollar stimulation when use of ecollar is part of a planned training protocol approved and/or requested by an owner. 5. I understand that my account must be paid in full at the beginning of each Home School package if that is the program I am participating in. I understand that my account must be paid in full at the onset of a multi-session training package if that is the program I am participating in. I understand that if I am participating in a consultation, single session, seminar or event, or dog sports practice payment is due by the end of that service. I understand that there will be no refunds and that Mindful Canine reserves the right to change rates over time. 6. I understand that any remaining balance or unused training will expire one year after day of purchase. 7. I understand that if I need to change or cancel my appointment that I must give at least 24 hour notice, and failure to do so results in forfeiture of that session. If two appointments are missed or changed without giving 24 hour notice, I will be required to pre-pay prior to scheduling any future appointments if I am participating in single sessions. I agree that if I am participating in a multi-session package and I miss two appointments without giving 24 hour notice, I forfeit all remaining sessions in my package and will not receive a refund. 8. I understand that I am responsible for understanding any reading materials provided by Mindful Canine. I agree that I will read and understand literature provided by the manufacturers of any products used in my dogs’ training and that faults and failures in these products are not the responsibility of Mindful Canine. 9. I agree that training collars, harnesses, muzzles, or other products intended by the manufacturer for training purposes will not be left on my dog(s) overnight or while my dog is unattended. 10. I understand that there is no guarantee for any training done with my dog(s). Training can be a lengthy process that requires consistency from the dog owner. For this reason there is no guarantee for behavior change in my dog(s). I understand that aggression/reactivity is a complicated diagnosis and that behavior  may not completely recede with training. I agree that if my dog(s) displays aggressive/reactive behavior, that it is my responsibility to take management precautions including but not limited to muzzling. I agree that if my dog(s) displays aggressive or reactive behavior, that it is my responsibility to carefully manage my dog(s) during and outside of training sessions and that it is my responsibility to avoid problem situations. I agree that problem situations outside of my control may arise and that it is my responsibility to handle those situations with my dog and take accountability for outcomes. 11. I agree that in the event my dog(s) engages in an act of aggression toward another dog or person while participating in dog training, Mindful Canine staff may, in their sole discretion, use reasonable physical force to interrupt and stop the aggression. I further agree that I am solely responsible, financially or otherwise, for any harm or damage to other dogs, persons, and/or property arising out of my dogs’ behavior. 12. I grant permission for Mindful Canine or a photographer hired by Mindful Canine to take and use photos and/or video of my dog(s), my home or property where the dog is being trained, and myself for promotional purposes. I understand that none of my private information will be shared with the photo other than my dogs’ name, sex, breed type, and training facts. 13. Acknowledgement of Risk: By attending or participating in Mindful Canine training activities including but not limited to individual training sessions, multi-dog walks, outings/field trips, dog sporting events and practices, or socialization sessions is not without risk to trainers, myself, to my dog(s), and/or to third parties, and/or the pet(s) of third parties. The risks include, but are not limited to, the risk of property damage, personal injury from dog bites, scratches, or other injuries, death, infectious disease, and parasites. I agree that my dogs’ attendance and participation in Mindful Canine dog training, multi-dog walks, sporting events and practices, outings/field trips or socialization is voluntary and was undertaken with my knowledge of the known risks and other risks that may result from participation. Assumption of Risk: I agree that Mindful Canine has adequately informed me of the risks associated with dog training in this document and therefore I assume the risk of my dogs’ attendance and participation in Mindful Canine Training Activities. 14. I understand that sporting events are not covered by Mindful Canine insurance and agree to take on full responsibility for any incidents, damages, injuries related to dog sport practices, trials, and events and release Mindful Canine, its insurer(s) and Dark Star Ranch and its owners from any liability, legal obligation, and financial responsibility. 15. Release of Liability: In consideration for my dogs’ attendance and participation in Mindful Canine Training Activities, I fully release Mindful Canine from any and all claims and/or liability arising out of my dogs’ attendance at, or participation in, dog training, including all claims for personal injury, wrongful death, and property damage. I agree to defend, indemnify, and hold harmless Mindful Canine from any and all claims and costs, including attorney’s fees, arising out of or relating to my dogs’ attendance at, or participation in, Mindful Canine dog training, multi-dog walks, sporting events and practices, outings/field trips, or socialization, including claims of negligence against Mindful Canine, it’s partners, officers, agents and/or volunteers. 16. I understand and agree that these terms and conditions will also apply in full to any and all additional or future training services I request and receive from Mindful Canine • By submitting the form included with this Training Agreement/Liability Release and including a signature created by you,  you are acknowledging that all information you have submitted is accurate to the best of your knowledge and that you have carefully read this Liability Release and Training Agreement and understand its contents and agree to the Mindful Canine terms of service for dog training.By signing your name, you attest all information you have submitted is accurate to the best of your knowledge and that you have have read, understand, and agree to the LIABILITY RELEASE AND TRAINING AGREEMENT within this application:
