LIABILITY RELEASE AND HEALTH SERVICES AGREEMENT 1. I agree that I have voluntarily hired Mindful Canine to perform one or more of the following health services for my pet: basic hygiene services, dog walking, and/or nutritional counseling. I understand it is my responsibility to clearly communicate my wishes and expectations to my Mindful Canine health services staff member. I agree that Mindful Canine, as dog and cat professionals, determine how to keep my pet(s) safe while receiving a health service. I understand that I will obtain the best ongoing pet health results by following the recommendations of the Mindful Canine pet health professional. I understand that I am solely responsible for my pets’ health and safety and that I am responsible for providing a clean and safe environment for my pet(s), including but not limited to having regular hygiene and exercise routines and feeding a high quality diet approved by a licensed practicing veterinarian. 2. I attest that any pet(s) I enroll in Mindful Canine Health Services is in good health, does not have a confirmed or suspected parvovirus or respiratory infection, is free from all parasites, and has received all required vaccinations required by the State of Utah and recommended by my vet. I agree that if my pet has known or suspected health problems, my pet is under the care of a veterinarian and I am following the guidance of that veterinarian. I agree that I am obligated ongoing to report to Mindful Canine any signs of illness or infection in my pet(s) while they are participating in pet health services. 3. In the event of an emergency, I grant Mindful Canine, in its sole discretion, permission to seek out professional veterinary attention/care for my pet(s) at my own expense if I am unreachable or my pet is receiving a health service while I am not present. I understand that I will be contacted immediately in the event of an emergency through the phone number(s) I provide. 4. I agree that dogs and cats, as animals, may engage in or display behavior that may be aversive or dangerous to other animals or people. I agree that Mindful Canine may interrupt and/or cease my pets’ inappropriate behavior in the best interests of my own pet(s) and the safety of other animals and people. Such interventions include, but are not limited to: emergency handling techniques, fair and quick leash corrections/pressure, verbal feedback, and proportional ecollar stimulation when use of ecollar is part of a dog’s normal care routine at home and approved by and/or requested by me. 5. I understand that my account must be paid in full at the time of completion of each health service completed by Mindful Canine staff. I understand that there will be no refunds for services already rendered and that Mindful Canine reserves the right to change rates over time. I understand that any remaining balance or unused Health Services balance will expire one year after day of purchase. 6. I understand that if I need to change or cancel my pet health services appointment that I must give at least 24 hour notice, and failure to do so may result in forfeiture of services and that no refund will be given. 7. I agree that I will read and understand literature provided by the manufacturers of any products used in my pets’ home care, and that faults and failures in these products are not the responsibility of Mindful Canine. 8. I agree that training collars, harnesses, muzzles, commercial pet diets and food items, pet toys, pet management materials, pet bedding, or any other products intended by the manufacturer for pet use come with inherent risks. 9. I understand that aggression and reactivity can put people and animals at risk, and I agree that I have communicated any and all known and/or suspected aggression or reactivity information about my pet(s) to Mindful Canine. I agree that in the event my pet(s) engages in an act of aggression toward another animal or person, Mindful Canine staff may, in their sole discretion, use reasonable physical force to interrupt and stop the aggression. I further agree that I am solely responsible, financially or otherwise, for any harm or damage to other dogs and/or cats, persons, and/or property arising out of my pets’ behavior. 10. In the event that I request Mindful Canine staff to perform a health service for my pet when I am absent from home, I grant permission to members of Mindful Canine, LLC, to have access to my residence during the agreed upon time frame to perform the service.  11. I grant permission for Mindful Canine to take and use photos and/or video of my pet(s) for promotional purposes. I understand that none of my private information will be shared with the photo other than my pets’ name, sex, health information, and breed type. 12. I understand that being walked by a stranger can be a stressful event for any dog, and that outdoor activities come with inherent environmental risks and hazards. I accept all liability for my pet’s health and safety while my pet(s) is being walked by Mindful Canine staff. I understand that my pet(s) will not be allowed to walk off-leash unless I specifically request it. I understand the leash laws of my municipality and understand that Mindful Canine staff may decline to allow a pet off-leash in an area where off leash activity is not allowed or it is deemed inappropriate or unsafe for the pet to be off leash, even if off-leash activity was originally requested by me. I understand that an e-collar is not legally equated with a leash. I understand that there is an inherent safety risk for off-leash dogs, and assume all liability and accountability in the event that my dog(s) becomes lost, injured, or deceased while participating in an off-leash walk that I requested. 13. I understand that hygiene/grooming services are stressful for pets and come with inherent risks for any pet, and agree to disclose any diseases, infections, skin abnormalities (including skin tags and moles), and health disorders, including parasite, flea, tick, and lice infestations to Mindful Canine staff before my pet receives a hygiene service. I understand that Mindful Canine may be unable to begin or finish some hygiene/grooming services in the event that it becomes too stressful or physiologically unsafe to perform for the pet(s), even if I have requested it and other services, either full or in part, are included. I agree to pay for all performed services that I requested and will not receive a refund for services already completed. I understand that Mindful Canine provides routine nail trims, baths, and brushing and does not provide haircutting at this time. 14. I understand that Mindful Canine provides basic nutritional counseling about various available pet foods and their features, and can provide basic recommendations about options that may benefit my pet. I understand that Mindful Canine provides basic nutritional counseling that is consistent with industry standards and current veterinary recommendations in order to help clients understand what their options are and make an understanding of pet nutrition accessible to the public. I understand that Mindful Canine is not a veterinary facility and does not have a veterinarian on staff, and that it is my responsibility to involve a veterinarian of my choice to select an appropriate pet food for my animal. I understand that Mindful Canine cannot diagnose or treat any illness, and that my pet’s medical expenses and care are ultimately my responsibility. 15. Acknowledgement of Risk: By enrolling my pet(s) in or participating in Mindful Canine Health Services, I agree that doing so is not without risk to Mindful Canine health services professionals, myself, to my pet(s), and/or to third parties, and/or the pet(s) of third parties. The risks include, but are not limited to, the risk of property damage, personal injury from dog or cat bites, scratches, or other injuries, death, infectious disease, and parasites. I agree that my pets’ participation in Mindful Canine Health Services is voluntary and was undertaken with my knowledge of the known risks and other risks that may result from participation. Assumption of Risk: I agree that Mindful Canine has adequately informed me of the risks associated with health services and therefore I assume the risk of my pets’ enrollment in and participation in Mindful Canine health services and related activities (such as “pack walks”). 16. Release of Liability: In consideration for my pets’ enrollment and participation in Mindful Canine Health Services, I fully release Mindful Canine from any and all claims and/or liability arising out of my pets’ enrollment in or participation in health services, including all claims for personal injury, wrongful death, and property damage. I agree to defend, indemnify, and hold harmless Mindful Canine from any and all claims and costs, including attorney’s fees, arising out of or relating to my pets’ enrollment or participation in Mindful Canine health services, multi-dog walks with dogs living in same household, owner approved outings/field trips, or owner approved socialization, including claims of negligence against Mindful Canine, it’s partners, officers, agents and/or volunteers. 17. I understand and agree that these terms and conditions will also apply in full to any and all additional future health services I request and receive from Mindful Canine.  • By submitting the form included with this Health Services Agreement/Liability Release and including a signature created by you,  you are acknowledging that you have carefully read this Liability Release and Health Services Agreement and understand its contents and agree to the Mindful Canine terms of service for health services.
