I understand and expressly agree that my use of this Fight Flow Academy facility involves the risk of injury to me or my guest whether caused by me or not. Such injuries may result from negligence, equipment failure, or human error. I understand that these risks can range from minor injuries to major injuries including death. In consideration of my participation in the activities and use of the facilities, exercise equipment, classes or services offered by Fight Flow Academy, I understand and voluntarily accept full responsibility on my behalf and on my guest’s behalf for the risk of injury or loss arising out of or related to my use or my guest’s use of the facilities, exercise equipment or participation in exercise programs or other services.
I agree that I acknowledge that Fight Flow Academy or any affiliates are not responsible for lost, damaged, or stolen items. I further agree that I am responsible for any damages to the facility or equipment directly caused by my misuse or negligence. I further agree that Fight Flow Academy, its affiliated companies and their respective officers, directors, employees, members, agents and independent contractors (collectively “Fight Flow Academy”) will not be liable for any injury, including, without limitation, personal, bodily, or mental injury, disability, death economic loss or any damage to me, my spouse or domestic partner, guests, unborn child, heirs, or relatives resulting from the negligent conduct or omission of Fight Flow Academy or anyone acting on Fight Flow Academy’s behalf whether related to exercise or not. Accordingly, to the fullest extent permitted by law, I do hereby forever release, waive and discharge Fight Flow Academy from any and all claims, demands, injuries, damages, actions or causes of action against Fight Flow Academy. I further understand and acknowledge that Fight Flow Academy does not manufacture fitness or other equipment or products available in its facilities, but purchases and/or leases equipment and therefore Fight Flow Academy will not be held liable for defective equipment or products. I understand this release of liability and assumption of risk agreement and I have been given the opportunity to ask questions related to my use of the facilities, exercise equipment, or my participation in exercise programs or other services. I further agree to comply with Fight Flow Academy’s membership policies and club rules that may be communicated to me from time to time either in writing, through club signage or verbally. Fight Flow Academy may, in its sole discretion, modify the policies and any club rule without notice at any time. Fight Flow Academy reserves the right to terminate any membership immediately for violation of membership policy or club rule. Members are required to display their Membership Card and check in at the reception desk when entering the facility.
● Management reserves the right to refuse entry to any member or guest or to cancel a membership at any time and for any reason.
● For members, we reserve the right to obtain new expiration dates from card issuers who make these dates available until you have cancelled in accordance with this agreement.
● All services are provided exclusively by employees or contractors of Fight Flow Academy. Members and member’s guest may not provide services or solicit clients in club.
● Fight Flow Academy does not permit the use of facilities by minors under the age of 18 without a guardian being physically present at the club, assumes all liability, and cannot leave the minor unattended unless the minor is exercising with a Fight Flow Academy professional.
CHANGE OF MEMBERSHIP POLICY
● Memberships can be frozen for a fee of $10 per month for up to 3 months per calendar year with written notice.
● 3 Business days notice is required to freeze an account.
● Freeze fees will not be accepted as the last month of dues.
● A 30 day written notice prior to the billing cycle will be required to cancel all existing memberships. Notice can be provided via e-mail or certified mail.
● Refunds will not be given for partial, expired or unused dues or private training packages.
● The last month's dues will be automatically drafted at the time notice is provided, although membership privileges will be provided for the entire duration of the paid amount.
ACKNOWLEDGEMENT
I have read and agree to all the terms and conditions as set forth on the front and back of this agreement I certify, to the best of my knowledge, I am in good physical health and that there is nothing that would prevent me from engaging in the exercise programs or use of equipment or use of any treatment or service offered in the Club. I certify that I have read the section regarding the Club’s lack of liability and my assumption of risk. I agree that I am responsible for seeking training for any equipment or exercise with which I am not familiar.
