Informed Consent and Liability Waiver Release for Participation in Exercise with MegaThrive Coaching LLC

I agree and consent to the following:

I am voluntarily participating (for myself or as my child’s parent/guardian) in a MegaThrive Coaching LLC exercise program.  I recognize that the program requires physical exertion that may be strenuous at times and may cause physical injury.  I am fully aware of the risk and hazards involved.

I agree (for myself or as my child’s parent/guardian) to be solely responsible for safety and well-being of myself. I understand that MegaThrive Coaching LLC does not provide supervision, instruction, or assistance for the use of the facilities and equipment.    

I understand (for myself or as my child’s parent/guardian) that it is my responsibility to consult with a physician prior to and regarding my participation in the above-mentioned program. I represent and warrant that I have no medical condition that would prevent my participation in the program.

I agree (for myself or as my child’s parent/guardian) to comply with all rules imposed by MegaThrive Coaching LLC regarding the use of the facilities and equipment. I agree to conduct myself in a controlled and reasonable manner at all times, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose.

I understand and agree (for myself or as my child’s parent/guardian) that MegaThrive Coaching LLC is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.

I agree (for myself or as my child’s parent/guardian) to assume full responsibility for any risks, injuries or damage known or unknown which I might incur as a result of participating in the program. Such injuries may include, but are not limited to, heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, injures to back, injuries to foot, or any other illness or soreness, including death.

I knowingly, voluntarily and expressly waive any claim I may have against MegaThrive Coaching LLC for injury or damages that I may sustain as a result of participating in the program.

MEDICAL EMERGENCIES. I hereby give my permission for MegaThrive Coaching LLC and/or an appropriate medical facility to take whatever emergency (first aid, disaster evacuation, etc.) measures as judged necessary for the care and protection of me (or my child) while participating with MegaThrive Coaching LLC.  In case of an emergency, I understand that I (or my child) will be transported to an appropriate medical facility by the local emergency unit for treatment if the local emergency resources deem it necessary. Transportation will be at my own expense. It is understood that in some medical situations, MegaThrive Coaching LLC will need to contact the local emergency resource before the parent, physician, guardian or emergency contact can be reached.

I, my heirs or representatives, forever release waive, discharge and covenant not to use MegaThrive Coaching LLC for any injury or death caused by their negligence or other acts.

MEDIA RELEASE. Participants involved in any activities offered by MegaThrive Coaching LLC may be photographed or videotaped during training. I (or on behalf of my child) hereby consent to the use of these photographs and/or videos and/or my likeness or image without compensation, on MegaThrive Coaching LLC website or in any editorial, promotional or advertising material produced and/or published by MegaThrive Coaching LLC, including its social media outlets.

I have read the above waiver and release of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above.
