Liability Waiver

I hereby certify that I am over eighteen (18) years of age, and am of sound mind at the time of the execution of this Waiver, Release, Hold Harmless, and Indemnification Agreement (hereinafter “Release”) and agree to the following: I agree to release and indemnify The Biscuit Factory Cat Café, LLC and our rescue partner, Happy Cats Haven (and for the purposes of this agreement shall also include its Officers, Agents and Volunteers collectively) from and against all liability, claims demands, damages to myself or my legal minor if in my presence, or property suffered or sustained as a direct or indirect result of the participation at The Biscuit Factory Cat Café, LLC. I, on behalf of myself and the minor(s) under my legal care or others in my party, acknowledge that playing with The Biscuit Factory Cat Café, LLC cats may not be supervised and we will be at our own free-will to engage with said animals. We assume the risk associated with this type of arrangement. The Biscuit Factory Cat Café, LLC staff will remain on the premises to monitor the cat lounge and café area, offer support and encouragement, and be available to assist me/us if I/we need any assistant with, or without the cats, however I take on all assumed risk for myself and the legal minor(s) under my care or those in my booked party. I am aware of and fully understand the dangers involved in playing with/picking up/engaging, with cats.

I acknowledge that I am voluntarily participating in such activities, or allowing the minor(s) under my legal care to do so, and these activities will not be covered under the insurance policy of The Biscuit Factory Cat Café, LLC or their partnered rescue affiliates. Although both parties screen cats for temperament as a precautionary step, as a participant, I promise to watch the cats carefully and will not approach, or allow the minor(s) under my legal care to approach any cat that seems nervous, stressed or who is eating.  The Biscuit Factory Cat Café, LLC cannot be held responsible for injuries I, or the legal minor(s) in my care, may sustain while engaging cats in any way.  I will use my best judgment, be aware of the cats and my surroundings, for myself and the legal minor(s) under my care. I will not pick up the cats, and will refrain from loud or rambunctious movements/sounds as to not frighten the cats and the other guests while I am visiting.

I agree that myself AND the legal minor(s) under my care and those in my party, have no physical or emotional issue(s), including, but not limited to, any allergies, which would adversely affect his/her ability to play with the cats in a safe and appropriate manner. Furthermore, since minors are not of the mature age to make adult decisions and take adult actions, I, on behalf of myself and the legal minor(s) in my presence while visiting (OR for the legal minor under my care, who is allowed on the The Biscuit Factory Cat Café premises without my presence) agree to abide by all rules set forth at The Biscuit Factory Cat Café IF UNWILLING TO FOLLOW RULES SET FORTH, I AM FULLY AWARE THAT WE MAY BE ASKED TO IMMEDIATELY LEAVE THE PREMISES IF ASKED UP TO 3 TIMES FOR SUPERVISION OF MINORS, OR INAPPROPRIATE HANDLING OF THE CATS OF ANYONE OF ALL AGES. While on the The Biscuit Factory Cat Café premises, photographs and video may be taken for social media purposes. Your image may be used for this reason. If you choose NOT to have your photo taken while participating in The Biscuit Factory Cat Café activities, please let a staff member know.

COVID-19 WARNING: An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is a contagious disease that can lead to severe illness or death. According to the CDC, senior citizens and guests with underlying medical conditions are especially vulnerable. By visiting The Biscuit Factory Cat Café, you voluntarily assume all risks related to exposure to COVID-19.
