2024 Community Market Rules and Policies Agreement

This agreement is between The Roudenbush Community Center (TRCCI)'s Roudenbush Community Market (Market) and the Vendor stated below (Vendor).

Rules and Policies

  1. If a Vendor cannot attend the Market, the Market Manager must be notified at least 24 hours in advance at telephone number: (978)496-1707 ext 100 or email roudenbush@roudenbush.org after the hour of 4pm please call (978)496-9077.
  2. Selling at the Market shall begin promptly at 3:00pm, and no selling may take place before this time.
  3. Vendors shall arrive no earlier than 1:30pm to set up displays.
  4. Vendors must agree to sell for the entire Market day (3pm to 7pm).
  5. Vendors must vacate the selling area no later than 7:45pm and all clean-up must be completed.
  6. No Vendor shall engage in solicitation, collection drives, political or religious activities in the Market. No loud hawking of items is allowed.
  7. Vendors must keep the vicinity in and around their selling area clean at all times and remove all refuse and unsold items at the end of each Market day.
  8. Vendors must provide an approved trash receptacle.
  9. Vendors must be courteous to other vendors and to the public at all times. Vendors and their agents, employees and representatives must maintain a neat and clean personal appearance at all times.
  10. No Vendor shall smoke tobacco, use electronic nicotine delivery systems (vape), drink alcohol and/or posses or use any controlled substance while at the Market.
  11. No Vendor shall discriminate against any member of the public or other Vendors on the basis of race, ethnicity, gender, religion, national origin and sexual orientation. Such discrimination is prohibited under both state and federal law. Allegations of discriminatory actions, if proven to be true, will not only result in the Vendor’s expulsion from the Market and may also result in further legal action for civil rights violations.
  12. You are not allowed to use stakes, but you must secure all tents and other amenities to maintain a safe area.
  13. Each tent leg must have 40lb weights to ensure it is securely grounded.
  14. No set up prior to 1:30 pm or after 3:00 pm, you must be set up by the time the Market opens, and MAY NOT TAKE DOWN BEFORE 7:00pm.
  15. You must leave your area as it was found. No moving benches, or leaving ice, debris, or garbage.
  16. If samples or preparation (i.e., corn husking) generate waste, you must provide and remove disposal container(s).
  17. The Town of Westford has a ban on polystyrene containers and single use bags. You must comply with the town by-laws.
  18. PLEASE NOTE: There will be no electricity on site, please provide your own generator if needed.

Unloading/Parking: Temporary unloading and loading may take place next to field area on Fisher Way. Fisher Way is located next to Abbot School at 25 Depot Street, Westford, MA. All Vendor vehicles will be parked in the parking lot next to Abbot School for the duration of the Market.

Scales:  All scales must be sealed and inspected per Massachusetts laws.

Signage: All Vendors must post prices for all items. All “Brought In” products must label place of origin with prices of each listed clearly.

Weather exceptions: Weather cancellations will be decided by 12pm the day of the Market, at that time you will be offered a chance to sell in the Roudenbush gym located at 65 Main Street Westford, MA (space may need to be reduced to a 6-foot table to accommodate multiple vendors), it will be communicated through email/phone call and posted on the TRCCI website (roudenbush.org)  as well as the TRCCI Facebook page (https://www.facebook.com/roudenbush). If there is visible lightening, high winds, heavy rain, or other inclement weather conditions after the start of the Market, the Market Manager will make a public announcement to inform Market shoppers and Vendors of the lightening or other conditions.  Vendors may leave if they feel unsafe due to the presence of lightening or other inclement weather conditions.

Photograhs and Publicity: I consent to the use of photographs, videos or other media recordings of myself and my products taken at the Market for promotional or publicity purposes by TRCCI.

INSURANCE

All Vendors selling consumable goods and items used on the body (lotions, soaps etc.) must submit an Insurance Certificate showing General Liability Coverage and MUST list the TRCCI, 65 Main Street, Westford, MA as an Additional Insured.  All Vendors not selling consumable goods (flowers, pottery, art, books etc.) must fill out a waiver to omit Insurance and liability of TRCCI.

PERMITS

If you are vending food you will need to submit a Market Permit Application (will be called a Farmers Market Application https://permits.westfordma.gov/) to the Westford Health Department. All food Vendors must have a valid food permit from the city or town where the food is stored and/or produced.

Please contact Westford Board of Health https://permits.westfordma.gov to fill out the  Market permit.

INDEMNIFICATION

I hereby agree that I will indemnify and hold harmless the TRCCI, all agents, and/or employees from any and all claims and liabilities arising or allegedly arising from my negligent or intentional conduct. I understand that this means that I will be responsible for reimbursing the above organization and individuals for any judgment against them, any settlement made by them in good faith, and any attorney’s fees incurred by them in defending or settling any claim against them, which arises or allegedly arises as the result of my negligent or intentional conduct.

Compliance with Laws: I agree to comply with all applicable laws, regulations, and guidelines related to the sale of non-consumable products at the Roudenbush Community Market, including but not related to health and safety regulations, product labeling requirements and taxation laws.

Representation of Products: I represent and warrant that all non-consumable products sold by me at the Roudenbush Community Market are safe, legal, and free from defects. I agree to promptly remove any products that are found to be unsafe, illegal or defective.

No Guarantees: I acknowledge that TRCCI makes no guarantees or representations regarding the success of my sales or the profitability of my participation in the Market.

WAIVER

By submitting this application, I hereby agree to comply with the RULES and POLICIES in all respects. I further agree to abide by the decisions of TRCCI, its officers, directors, agents and/or employees regarding the interpretation and enforcement of any provision of the RULES and/or of POLICIES. I specifically understand that, in consideration for processing my application, I waive any and all rights to pursue any civil or criminal process against TRCCI, its officers, directors, agents and/or employees as relates to any decisions and/or action taken in interpreting or enforcing the RULES and POLICIES by TRCCI, its officers, directors, agents and/or employees. I understand that by submitting this application, I am waiving legal rights that I may have as described above, and I do so voluntarily.

I have read and understand the Rules & Policies Indemnification, Waiver, and swear to abide and respect them.
