I acknowledge and understand that Crooked Creek Highlands is a working farm and activities at the farm include serious risk or harm. I understand I may be exposed, including but not limited to: wildlife, farm animals, insects, inclement weather, heavy machinery, tools, farm equipment, electric fencing, holes in the ground and negligence of employees or volunteers. I understand that is not inclusive of all possible risks all of which may involve personal injury, death, or damage to property. I agree that I will obey all signs, warnings, and instruction from my guide while at Crooked Creek Highlands, LLC. In the event that any damage to livestock, equipment, fencing, gates, or any facilities occurs as a result of my or my families’ willful actions, negligence, or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions or negligence. I agree this waiver shall be interpreted broadly and inclusively as North Carolina state law permits. In the event that any clause in this provision be held invalid by any court or competent jurisdiction, the invalidity of a clause shall not otherwise affect the remaining provisions of this waiver and it shall continue to be enforceable. If I do not follow the instruction at Crooked Creek Highlands, LLC, I may be asked to leave the property without refund.

I willingly and knowingly release Crooked Creek Highlands, LLC and it officers, owners, landowners, photographers, and agents from any and all liability. I agree to assume all risks and responsibilities in my participation. I understand I shall be solely responsible for any medical or any other costs arising from injury or damage. I agree that I will not file litigation against Crooked Creek Highlands, LLC, owners, land owners, employees, volunteers, or agents for any liability including accident, injury, theft, property damage, and the like.

I agree that I am physically and mentally fit to participate in activities at Crooked Creek Highlands, LLC. I understand that there are no medical services available on site. Additionally, there are no restrooms on site. I give permission to Crooked Creek Highlands, LLC to authorize emergency medical treatment for me. I release Crooked Creek Highlands, LLC and its officers, land owners, employees, volunteers, photographers, and agents for any liability arising to injury, damage, or death.

I agree that while at Crooked Creek Highlands, photos and videos may be taken of myself and my children. I authorize Crooked Creek Highlands to share any photos or videos of myself and my children on social media, publications, websites, promotional material, and the like.

During my photo session, I may be up close and near livestock including animals with horns. I agree to follow all signs, warnings, and instructions. I agree to follow all directions given by Crooked Creek Highlands. I also acknowledge that the terrain could be rough and I must be careful of holes, fencing, gates, and the like. Additionally, there is electric fencing on the property. I agree not to open any gates, fencing, or the like unless permitted. Children under the age of eighteen (18) years old must be accompanied by a parent or guardian. Parents or guardians shall be responsible for their children during sessions. Photography sessions are $100 for 30 minutes to up to one (1) hour. I agree not to run, jump, yell, hit, grab, or the like at any animals. This is their home.

During my farm tour, I understand that I may be up close and near livestock including animals with horns. I agree to follow all signs, warnings, and instructions by my tour guide. I agree to wear close-toed shoes. I agree not to open any gates, fencing, or the like unless permitted by my guide. Additionally, there is electric fencing on the property. I agree not to run, jump, yell, hit, grab, or the like at the animals. This is their home. Professional photography is not allowed on the farm tours but you are welcome to take your own photos. If you are interested in taking professional photos, please contact us to book a time. Farm tours are $100 for up to four (4) people for a (1) hour tour. For each additional person, add $25. At this time, we cannot allow groups of more than ten (10) at one time.

During my paint session, I understand that I may be up close and near livestock includinganimals with horns. Additionally, there is electric fencing on the property. I agree not to run, jump, yell, hit, grab, or the like at the animals. This is their home.
