A completed waiver by a parent/ guardian is required for all minors ("Child") to enter and participate at The Playful Family, Inc.  As a parent or legal guardian of the Child whose name is set forth in this waiver (who is referred to here as the "Child") and in consideration of the Child being permitted to participate in the Activities (as defined below) considered by The Playful Family, Inc., the Child and I agree as follows:

In consideration of being allowed to enter and participate in any "Activities" at The Playful Family, Inc. ("Premises"), the undersigned acknowledges, understands, and agrees to the following:

1.  I am the custodial parent or legal guardian of the Child or have obtained parental authorization to act on their behalf concerning the Child to execute this agreement.

2.  I acknowledge that all applicable rules for participation must be followed, and I assume sole responsibility for the supervision and personal safety of the Child.

3.  I understand that The Playful Family, Inc. management may refuse the Child's participation in Activities for any reason, including, but not limited to:

a) Failure by the Child or me to follow The Playful Family, Inc rules.

b) My failure to remain on the Premises during the Child's participation in the Activities.

c) My failure to adequately supervise the Child or to ensure that the Child is adequately prepared for safe participation in the Activities.

d) The Child suffering from an illness or ailment of any kind that may impair his or her continued participation in the Activities, or that may be contagious or potentially harmful to others on the Premises.

4.  I, at this moment grant The Playful Family, Inc. and contracted photographers hired by The Playful Family permission to take pictures of myself and/or video, including but not limited to:  media, marketing, publicity, copyright purposes, illustration, advertising, social media, and web content.

5.  Activities:  The Child will participate in various activities offered by The Playful Family, Inc., including but not limited to the following:  The all-inclusive use of the Playful Playground indoor play center that is fully equipped and/or the participation in any party, event or program activity at The Playful Family, Inc.

6.  Medical Permission Authorization:  If the Child is of Minor age, the undersigned parent or guardian hereby gives permission for The Playful Family, Inc. staff to authorize emergency medical treatment as may be deemed necessary for the Minor named below while participating at The Playful Family, Inc. and hereby relieve The Playful Family, Inc. from all liability arising as a result of this medical authorization.

7.  Assumption of Risk:  Participation in the Activities carries with it certain inherent risks which cannot be eliminated regardless of the care taken to avoid injuries. The specific risks may range from contagious illnesses, including COVID-19, minor scratches, bruises, and sprains, to more serious injury, including disability and/ or death.  Notwithstanding these risks and other hazards that may be foreseeable but not specifically identified here, I, for myself and the Child and our respective heirs, personal representatives, and assigns, understand, acknowledge, and expressly and voluntarily assume all risks and full responsibility for any injury to Child or myself, and expressly and arising out of related to the Activities.  I hereby irrevocably waive, release and fully discharge The Playful Family, Inc. from any and all liability for loss, damage, personal injury, including death and disability, and costs of any kind and nature whatsoever which the Child or I may suffer now or in the future by reason of or existing out of any causes whatsoever related to or arising out of or from the participation of the Child in the Activities or presence of the Child on the Premises.

8.  Indemnification and Hold Harmless:  I agree to indemnify and hold The Playful Family, Inc. harmless from, without limitation, any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees and costs incurred due to claims brought by any third party as a result of or arising out of the Child's and/or my own involvement in the Activities and to reimburse The Playful Family, Inc. for any such costs, expenses, and fees as they are incurred.

9.  Release, Discharge, and agree not to sue:  I, for myself and the Child and our respective heirs, personal representatives, and assigns, do hereby release, discharge, and agree not to sue The Playful Family, Inc. and its managers, members, employees, and/or other agents, for any injury to or death of the Child or myself arising, directly or indirectly, from participation in the Activities.  This release, discharge, and covenant not to sue shall relate to any and all claims or legal rights now existing or arising in the future, including claims and legal rights arising out of any negligence of The Playful Family, Inc. and/or its managers, members, employees, and/or other agents and any other breach of a legal duty arising out of common law, statute, contract or otherwise.

10.  Severability:  This document is intended to be as broad and inclusive as is permitted by the laws of the State of Florida, and if any provision (or a part of any provision) contained herein is deemed to be invalid, the balance of the conditions shall continue in full legal force and effect, notwithstanding such invalidity.

I HAVE READ THIS AGREEMENT THOROUGHLY.  I UNDERSTAND THAT, BY SIGNING THIS AGREEMENT, I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I, THE CHILD, AND OUR RESPECTIVE HEIRS, ASSIGNS, EXECUTORS, ADMINISTRATORS, PERSONAL REPRESENTATIVES, AND NEXT OF KIN MAY HAVE AGAINST THE RELEASEES, INCLUDING THE RIGHT TO SUE.  I SIGN THIS DOCUMENT VOLUNTARILY AND WITHOUT INDUCEMENT.
