The following rules apply to use of the tennis courts and the rest of The Buccaneer property. Please review and sign below to indicate your agreement to comply with these terms:
- Players must check in at the main gate and have an advance reservation. Courts are limited to a maximum of four persons per court.
- A mask or face covering must be worn at all times while on property and may be removed during play.
- Adhere to the 15-mph speed limit while on property. Please use parking areas near the courts. Please avoid The Mermaid lot and room parking.
- Proper tennis shoes and attire are required. Running shoes, tank tops, bathing suits, and cut off jeans are not allowed.
- All players play at their own risk. Players are not permitted to play on wet or dirty courts as they may contain slippery debris, including leaves. Commencement of play is deemed to conclusively establish that the player has inspected the courts and accepted their condition.
- Neither The Buccaneer, Inc., nor its agent, employees, officers, or directors accept any liability for the use of the tennis courts and the adjacent tennis facilities, including the entire hotel property, which are used entirely at the player's own risk as an expressed condition of being able to use the tennis courts at The Buccaneer.
- Any dispute, controversy, or claim of any kind whatsoever, including but not limited to torts allegedly resulting in injuries while on the tennis courts or the hotel property, shall be settled by binding arbitration and judgement on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. This arbitration agreement covers all claims as set forth heroine between the undersigned and The Buccaneer, Inc., its agents officers, directors, and employees as well as the tennis Licensee, Warren Mosler, or his assigns, as well as his employees and any tennis instructors, and will continue from the time of acknowledgement of this agreement by the undersigned until it is otherwise terminated in writing by the agreement of the parties.
- Arbitration shall be conducted before a neutral arbitrator agreed upon by the parties in the Virgin Islands. If no arbitrator can be agreed upon, the parties agree that one may be appointed by any Court of competent jurisdiction required to enforce this agreement. Unless the parties agree otherwise, they must follow the Commercial Rules established by the American Arbitration Association, even through arbitration will not be conducted through that entity.
- If the arbitration clause in this agreement is deemed not to be enforceable for any reason, the parties expressly agree to waive their respective rights to a trial by jury as to any court proceeding that may take place.
- Children may not be left unattended while parent or child supervisor is playing tennis or otherwise engaged that negates supervision.
- Everyone playing tennis at The Buccaneer must sign this form before playing. If the tennis player is a minor child, his or her parent or legal guardian must sign on his or her behalf. The agreement will be binding unless you withdraw your agreement in writing at which time you will no longer be able to play tennis at The Buccaneer. No one can play with anyone who refuses to sign this agreement.
