WAIVER & RELEASE OF CLAIMS

I understand and agree that in consideration for use of the Hammond Hill Suburban Club and participation in activities on/at the Hammond Hill Suburban Club, I hereby waive and forever discharge any and all liability claims and demands of whatever kind or nature against Hammond Hill Suburban Club, its agents, representative, officers, directors, employees, instructors or Board of Governors (“Released Party”), either in law or in equity, including but not limited to damages or losses causes by the negligence, fault or conduct of any kind of the Released Party. This waiver and release includes but is not limited to death, bodily injury, illness, economic losses or out of pocket expenses, or loss or damage to property. I understand and agree that this waiver and release is binding on my heirs, assignee, next of kin and/or legally appointed or designated representatives and is intended to apply to and include any claims that may hereinafter accrue or arise from my participation in these activities. I agree and intent that this release and waiver is to be interpreted to provide full release of liability to the fullestextent permitted by law and waive any claim that I may have.

By signing this form Iagree and understand that my participation in activities at Hammond Hill Suburban Club include possible exposure to and illness from infectious diseases including but not limited to COVID-19; I knowingly and freely assume all such risks related to illnesses such as COVID-19 even if arising from the negligence or fault of Hammond Hill Suburban Club, its agents, representative or employees, and hereby release, waive and forever discharge any and all liability claims and demands of any kind or nature against Hammond Hill Suburban Club, its owners, successors, heirs, assigns, agents, employees and the Hammond Hill Suburban Club Board, for myself, my guests and any minors in my custody at Hammond Hill Suburban Club, for any illnesses or infectious disease exposure while present at Hammond Hill Suburban Club.

By signing this form, I agree to assume all risks arising from activities associated with use of the Hammond Hill Suburban Club, even those allegedly caused by the negligence or conduct of Hammond Hill Suburban Club agents, officers, representative and/or employees. I understand that there are inherent risks associated with the use of the Hammond Hill Suburban Club which may be both foreseen and unforeseen and include  but not limited minor injuries such as bruises, sprains and dehydration, major injuries such as back injuries, heat stroke, heart attack, serious injury or potentially catastrophic or fatal injuries such as paralysis or death. I have read the and understand the inherent dangers associated with the activities, specifically Swimming, Volleyball and Pickle Ball, played at Hammond Hill Suburban Club and I knowingly and voluntarily assume the risks associated with these activities.

INDEMNITY

By checking/signing this form I agree to Indemnify and hold harmless Hammond Hill Suburban Club, its owners, successors, heirs, assigns, agents, employees and the Hammond Hill Suburban Club board, from all liability for any loss, damage, injury, illness, death and/or expenses that I or any person(s) in my care, custody or present under my Hammond Hill Suburban Club association, may suffer arising out of the use of the Hammond Hill Suburban Club facilities and grounds.
