Service User Agreement

Do not perform any Services Provided by LiveColder Recovery LLC if you have any of the following conditions:

You may have other conditions that require additional precautions or make whole body cryotherapy, infrared sauna, Massage therapy, Cold Plunge and leg compression inappropriate, such as the following (Consult with your doctor or medical advisor if you have questions regarding if any of our offered services are right for you):

BY SIGNING BELOW YOU CONFIRM TO LiveColder Recovery LLC (THE "COMPANY") FOR THE BENEFIT OF THE RELEASED PARTIES (AS LATER DEFINED) THAT YOU HAVE CAREFULLY READ BOTH PAGES OF THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS, VOLUNTARILY AGREE TO EACH OF ITS TERMS AND PROVISIONS AND SIGN OF YOUR OWN FREE WILL.

Agreements:    1. Follow all instructions given to you by the attendant.    2. Participation in a whole body cryotherapy session involves exposure to extreme cold temperature for a short period of time (not to exceed three (3) minutes per session). Your clothing and skin must be dry. During your Cryotherapy session you must keep your chin facing upward and avoid inhaling the nitrogen gas that is emitted into the chamber. By signing this Agreement you confirm that you are in good health and do not have any of the contraindications identified above or other physical condition that would preclude you from safely using, massage therapy, whole body cryotherapy, Cold Plunge, Infrared Sauna or Leg Compression or red light therapy. If you experience any discomfort outside the norms of regular service operations please notify the attendant verbally, failure to do so could result in frostbite, nausea, light-headedness, unconsciousness, cramping, dehydration which are all specific risks that you assume.    3. If you experience any mental or physical discomfort at any time during any of the services, express this, and we will terminate the session immediately. You are free to walk out of the chamber, Cold Plunge, Sauna, Leg Compression seat or Massage therapy room at any time.    4. No representations or claims are made as to the therapeutic nature or other benefits of whole body cryotherapy, infrared sauna, Cold Plunge, or Leg Compression. Whole body cryotherapy, infrared sauna, Cold Plunge, or leg compression, are not intended to diagnose, cure or prevent diseases, illnesses, imbalances or disorders. Every customer is different and responds differently to the therapies.

5. Participation during Cold Plunge, you understand the risks associated with cold water submersion and take on full responsibility of following all instruction given by the assigned attendant.

Waiver and Release:    1. This is a release of liability and a waiver of certain legal rights.    2. By signing this Agreement you:    a. acknowledge that use of whole body cryotherapy involves risk of bodily injury, skin irritation and redness, cold skin rash or burn, temporary loss of consciousness, illness, disability or death. You acknowledge that you are voluntarily participating in ALL SERVICES PROVIDED BY LIVECOLDER RECOVERY LLC with knowledge of the dangers involved and accept and assume all forementioned risks, whether caused by the condition of the facilities or equipment or the negligence of the attendant or otherwise. LiveColder will do everything in the eyes of Arziona State Law to ensure the aforemnetioned risks are negated to the best of our abilities. You acknowledge that frostbite, nausea, light-headedness, slipping/tripping/falling on wet surfaces, unconsciousness, cramping, dehydration are specific risks that you assume in the LiveColder Recovery facility.    b. expressly waive and release any and all claims against LiveColder Recovery LLC, Impact Cryotherapy, Inc., and their respective officers, directors, employees, agents, affiliates, therapists, contractors, successors and assigns (which are collectively referred to as “the Released Parties”), arising out of or attributable to your use of whole body cryotherapy. You covenant not to assert any such claims against the Released Parties and forever release and discharge the Released Parties from liability for such claims.    c. indemnify and hold harmless the Released Parties from any loss, liability, damage, cost or expense arising out of or connected in any manner with your use of whole-body cryotherapy, infrared sauna, Cold Plunge or Leg compression    d. agree that this waiver and release is intended to be as broad and inclusive as permitted under law. You specifically acknowledge and agree that this Agreement is  intended to be a general release form subject to limitations and conditions that would otherwise apply under applicable state law and additionally you agree to waive all general release limitations provided by applicable law. General Provisions:    1. This Agreement shall be construed and interpreted as broadly as possible under the applicable law of the jurisdiction in which you use whole body cryotherapy, Infrared sauna, Cold Plunge and Leg Compressions with the words, terms, provisions, covenants, and remedies contained in this Agreement to be enforceable to the fullest extent permitted by applicable law.    2. If any portion of this Agreement is held invalid, the remainder shall not be affected and shall continue in full legal force and effect.    3. The terms of this Agreement shall continue from this date forever and shall apply to each use by you of ALL SERVICES OFFERED without the need for you to re-execute this Agreement.    4. This document constitutes the entire agreement regarding your use of whole body cryotherapy and any product, services or equipment connected with the Released Parties and supersedes all prior discussions, agreements and representations about the use, benefits or risks of whole body cryotherapy, Cold Plunge, Leg Compression and Infrared Sauna. This Agreement may only be modified in a writing signed by you and an authorized representative of LiveColder LLC.

BY SIGNING BELOW YOU CONFIRM YOU HAVE READ BOTH SIDES OF THIS AGREEMENT.

Monthly Membership

Please read and acknowledge the following LiveColder Recovery membership terms:

I understand that Auto-Pay Packages/Memberships will carry a three month commitment and a monthly autopay billing feature.  All memberships will carry a three month commitment and a monthly autopay billing feature and that I, the client, will have a set monthly billing date upon purhcase.  I agree to allow my payment information to be kept in order to execute monthly payments.

Unused "Sessions" will not carry over and will expire after 30 days of purchase.  All "Visit" purchased will expire 90 days after purchase. There will be no partial refund for unused sessions. 

CANCELLATION POLICY:

I will be able to cancel my Auto-Pay Packages/Membership at any time up to 3 days prior to my next scheduled autopayment date. I will have thirty (30) days from date of cancellation to use any unused sessions/visits remaining on my account. After this time-frame, post membership cancellation, I will not be able to perform any services with my plan, even in the case that I have sessions remaining on my account.

I will be able to cancel my Membership at any time up to 3 days prior to my next scheduled autopayment date and will be subject to a $200 month cancellation fee if I have not completed the full 3 month contract.

This membership is non-negotiable, transferable or cancelable except as otherwise provided herein. Clients who wish to cancel a membership should email your intent to, info@livecolder.com, at least 3 days prior to the next scheduled autopayment. 

ONLINE PRIVACY POLICY

LiveColder Recovery (LiveColder) values its users' privacy. This Privacy Policy ("Policy") will help you understand how we collect and use personal information from those who visit our website or make use of our online facilities and services, and what we will and will not do with the information we collect. Our Policy has been designed and created to ensure those affiliated with LiveColder Recovery of our commitment and realization of our obligation not only to meet, but to exceed, most existing privacy standards. We reserve the right to make changes to this Policy at any given time. If you want to make sure that you are up to date with the latest changes, we advise you to frequently visit this page. If at any point in time LiveColder Recovery decides to make use of any personally identifiable information on file, in a manner vastly different from that which was stated when this information was initially collected, the user or users shall be promptly notified by email. Please note that this Policy does not govern the collection and use of information by companies that LiveColder Recovery does not control, nor by individuals not employed or managed by us. It is always up to you whether to disclose personally identifiable information to us, although if you elect not to do so, we reserve the right not to register you as a user or provide you with any products or services. This website collects various types of information, such as: · Voluntarily provided information which may include your name, address, email address, billing and/or credit card information etc. which may be used when you purchase products and/or services and to deliver the services you have requested. · Information automatically collected when visiting our website, which may include cookies, third party tracking technologies and server logs. In addition, LiveColder Recovery may have the occasion to collect non-personal anonymous demographic information, such as age, gender, household income, political affiliation, race and religion, as well as the type of browser you are using, IP address, or type of operating system, which will assist us in providing and maintaining superior quality service. LiveColder Recovery may also deem it necessary, from time to time, to follow websites that our users may frequent to gleam what types of services and products may be the most popular to customers or the general public. Please rest assured that this site will only collect personal information that you knowingly and willingly provide to us by way of surveys, completed membership forms, and emails. It is the intent of this site to use personal information only for the purpose for which it was requested, and any additional uses specifically provided for on this Policy.

LiveColder Recovery does not now, nor will it in the future, sell, rent or lease any of its customer lists and/or names to any third parties. LiveColder Recovery may collect and may make use of personal information to assist in the operation of our website and to ensure delivery of the services you need and request. At times, we may find it necessary to use personally identifiable information as a means to keep you informed of other possible products and/or services that may be available to you from www.livecolder.com LiveColder Recovery may also be in contact with you with regards to completing surveys and/ or research questionnaires related to your opinion of current or potential future services that may be offered. 

Disclosure of Information 

LiveColder Recovery may not use or disclose the information provided by you except under the following circumstances: · as necessary to provide services or products you have ordered; · in other ways described in this Policy or to which you have otherwise consented; · in the aggregate with other information in such a way so that your identity cannot reasonably be determined; · as required by law, or in response to a subpoena or search warrant; · to outside auditors who have agreed to keep the information confidential; · as necessary to enforce the Terms of Service; · as necessary to maintain, safeguard and preserve all the rights and property of LiveColder Recovery. 

Non-Marketing Purposes 

LiveColder Recovery greatly respects your privacy. We do maintain and reserve the right to contact you if needed for non-marketing purposes (such as bug alerts, security breaches, account issues, and/or changes in LiveColder Recovery products and services). In certain circumstances, we may use our website, newspapers, or other public means to post a notice.

Children under the age of 13 

LiveColder Recovery's website is not directed to, and does not knowingly collect personal identifiable information from, children under the age of thirteen (13). If it is determined that such information has been inadvertently collected on anyone under the age of thirteen (13), we shall immediately take the necessary steps to ensure that such information is deleted from our system's database, or in the alternative, that verifiable parental consent is obtained for the use and storage of such information. Anyone under the age of thirteen (13) must seek and obtain parent or guardian permission to use this website. 

Unsubscribe or Opt-Out

 All users and visitors to our website have the option to discontinue receiving communications from us by way of SMS, email or newsletters. To discontinue or unsubscribe from our website please send an email that you wish to unsubscribe to info@livecolder.com. If you wish to unsubscribe or opt-out from any third-party websites, you must go to that specific website to unsubscribe or opt-out. LiveColder Recovery will continue to adhere to this Policy with respect to any personal information previously collected.

Our website does contain links to affiliate and other websites. LiveColder Recovery does not claim nor accept responsibility for any privacy policies, practices and/or procedures of other such websites. Therefore, we encourage all users and visitors to be aware when they leave our website and to read the privacy statements of every website that collects personally identifiable information. This Privacy Policy Agreement applies only and solely to the information collected by our website.

Notice to European Union Users 

LiveColder Recovery's operations are located primarily in the United States. If you provide information to us, the information will be transferred out of the European Union (EU) and sent to the United States. (The adequacy decision on the EU-US Privacy became operational on August 1, 2016. This framework protects the fundamental rights of anyone in the EU whose personal data is transferred to the United States for commercial purposes. It allows the free transfer of data to companies that are certified in the US under the Privacy Shield.) By providing personal information to us, you are consenting to its storage and use as described in this Policy.

LiveColder Recovery takes precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.
