This is a legally binding release, waiver, indemnification of liability, and express assumption of risk. Client understands that Pilates and other fitness programs (hereinafter referred to as “Pilates ”) involve physical exertion, are strenuous, and that injuries may occur when participating in such activities. I recognize that many changes may occur as a result of these exercise sessions, including possible short-term aggravation of some symptoms: feelings of lightheadedness, increased energy, mood changes etc. Client understands that hands-on cues, corrections, feedback, or adjustments may be required from time to time and will notify instructors if they have any existing injuries, allergies, or other conditions or preferences that make them not want to be physically touched.
Client accepts and assumes the risks associated with Pilates, including, but not limited to, equipment malfunction or failure, overexertion, inability to perform suggested exercises or maneuvers, physical or mental conditions that impede the ability to properly perform suggested exercises or maneuvers, failure to properly operate equipment, and failure to follow instructions. Client hereby freely and expressly assumes all risk of property damage, injury, and death associated with Pilates, including the risk of Covid19 or any other communicable diseases. Client understands that it is his/her responsibility to consult with a physician prior to and regarding participation in Pilates. Client represents and warrants that he/she has no physical or mental condition that would prevent full participation in Pilates.
Client agrees to inform his/her instructor immediately of any physical or mental condition that would prevent his/her full participation in Pilates. In consideration for participation in Pilates, receiving instruction and use of Cleveland Pilates LLC equipment and facilities, Client hereby agrees to release, hold harmless, and indemnify Cleveland Pilates LLC and its owner, partners, employees, independent contractors, directors, officers, agents, instructors, licensees, and affiliates from any and all claims by or on behalf of Client against Cleveland Pilates LLC arising directly or indirectly out of Participant’s participation in Pilates, use of any equipment or facilities, and participation in any class, program, or workshop offered by Cleveland Pilates. I expressly waive, release and discharge Cleveland Pilates LLC, its owner, and/or independent contractors from any obligations, liabilities, claims demands, costs and expenses, including attorney fees, arising out of, or in connections with any bodily injury, however, caused, occurring during or after my participation in the exercise program and workshops.
Cleveland Pilates LLC , its owner, and/or independent contractors shall not be liable for any injuries or damages to any participant, or the property of any participant, or be subject to any claim, demand or injury, or damages whatsoever, including without limitations, those damages or injuries resulting from negligence on the part of Cleveland Pilates LLC, and/or independent contractors. If signing on behalf of a minor Client, Parent/Guardian accepts full responsibility for any medical expenses incurred due to the minor’s participation in Pilates and agrees to release, hold harmless, and indemnify (including costs and attorney’s fees) Cleveland Pilates LLC for any claims brought by or on behalf of the minor.
Cancellation/Refund Policy: 24-hour advance notice is required to change or cancel an appointment without charge. Failure to cancel your session within 24 hours through these designated channels may result in the forfeiture of the session. Appointments and attendance may be cancelled by phone, email, or in fit by wix app. All purchases are non-refundable. All packages are valid for a maximum of 6 months after the date of purchase.
Cleveland Pilates LLC and its owners and employees do not treat, cure, or diagnose ailments and medical concerns. Cleveland Pilates is not a physical therapy center. Cleveland Pilates LLC offers movement and exercise to help strengthen the body and core through the practice of Pilates as originated by Joseph Pilates. Pilates is an exercise regimen that can help with injury prevention and does not in any way medically rehabilitate specific past, current, or future injuries as performed in Physical Therapy. If you are experiencing ongoing discomfort/pain or have a recent injury that has not been medically treated, consult a physician before participating in any Pilates/fitness related activities.
This release is binding upon Client, and Client’s heirs, assigns, and legal representatives.
