Terms of Contract
§ 1 Scope
The following terms and conditions apply inin the version valid at the time of the conclusion of the contract, in addition to the applicable laws for the current and future business relationships between Legacy Boxing Club GmbH & Co.KG and the member. These still apply even if they have not been expressly agreed again. Deviating conditions of the member are not recognized unless the user expressly agrees to their validity in writing.
§ 2 Subject of the contract
Legacy Boxing Club GmbH & Co.KG contractually offers training for its members in various sporting disciplines, particularly in the field of hand-to-hand combat. For this purpose, Legacy Boxing Club GmbH & Co.KG will organize courses, workshops, and seminars, among other things.
§ 3 Scope of Services
The scope of the service includes fitness (muscle building, weight gain or weight loss), boxing (condition, coordination, punching techniques), hand-to-hand combat (realistic self- defense, self-protection, defense against weapons), use of equipment. A personal trainer is available for all areas offered by appointment.
§ 4 Contract period
A membership can be requested for the duration of 12 or 24 months. The contract is extended for an indefinite period if the member does not terminate the contract in writing by handing it over in person, by email or via mail, 4 weeks before the end of the contract period. After the end of the regular contract period, members can cancel at the end of the month. During the fixed contract period, the member has no right of ordinary termination. The right to extraordinary termination remains unaffected.
§ 5 Extraordinary right of termination of the contract
A member has the right of extraordinary termination of his/her contract in the event of a change in residence which must be more than 40 km away from Legacy Boxing Club GmbH & Co.KG and his/her last place of residence. Notice of termination or closure must be given within 2 weeks of knowledge of the circumstances leading to termination of the contract.
§ 6 Obligation to contribute
Legacy Boxing Club GmbH & Co KG charges its members a monthly fee in advance. The amount of the contribution depends on the chosen type of membership. Further information is provided on the price list valid at the time the contract was concluded and specified in the application form. In order for members to receive their membership ID, Legacy Boxing GmbH & Co KG will charge a one-time payment of EUR 20.00. Only one ID card per member will be issued. If a member is more than three months in arrears of their payments, they can be excluded from the training facilities and the membership fee for the remaining agreed membership is due immediately and in a full amount until the next possible ordinary end of the contract in accordance with §259 ZPO. In the event of closure due to official requirements, the obligation to pay contributions for this period does not apply. (cf. judgment of the AG Hamburg, Az.: 9c 95/21). The membership fee must be paid no later than the 5th of each month.
§ 7 Rights and obligations of the member
Every member must show his membership card at the beginning of a visit to Legacy Boxing Club GmbH & Co KG without being asked. After termination of membership, the
member must return his membership card to Legacy Boxing Club GmbH & Co KG without being asked. A member undertakes to ensure that his bank account has the necessary funds to participate in the direct debit procedure. All members are authorized to use the facility and participate in training sessions of Legacy Boxing Club GmbH & Co KG in a respectful and appropriate manner. Members are to notify Legacy Boxing Club GmbH & Co KG of any change of address or account details well ahead before these changes occur.
§ 8 Liability
The practice of sports is always associated with a risk of injury. In particular, the offered close combat trainings can carry a considerable risk of injury. Members who wish to go through this training are advised to revise their insurance coverage and if necessary, consult a doctor, whether it is safe for them to take part in such a training course before beginning the offered courses. Legacy Boxing Club GmbH & Co KG shall not be liable for slightly negligent breaches of duty, if these are not essential contractual obligations, by which the purpose of the contract is endangered or damage resulting from injury to life, body, or overall health. The same applies to the breach of duty by the user's vicarious agents. An essential contractual obligation is the device maintenance and proper advice to members regarding the use of equipment and training according to § 3.
§ 9 Membership Fee
The membership fee is based on age and is automatically adjusted accordingly. The legal guardians were informed about this process, which automatically came into force when the contract was signed and concluded.
§ 10 Hygiene regulations
The training may not be attended with street shoes. We would also like to point out that corona-related distance regulations must be retained. Wearing a face mask indoors is necessary when members are not using any training devices or currently undergo a training session if this is required by governmental law.
§ 11 Safety regulations
The provided training equipment may only be used for their intended purpose. If a member is unsure of the right use of a training device, he is to consolidate a member of staff before he proceeds with his training.
§ 12 Regulation of a potential business interruption
Complete business interruptions of the boxing club of a maximum of 21 calendar days are possible if renovation, cleaning, or repairs are pending. Business interruptions are announced at least seven days in advance by means of a notice.
§ 13 final provision
The invalidity of one or more provisions does not affect the validity of the remaining provisions.
