Be informed about the risks: Without a certain degree of risk, aerial sling students would not improve their skills and the enjoyment of the activities would be diminished. Aerial sling activities expose participants to the usual risk of cuts and bruises. Other more serious risks exist as well. Participants can fall off equipment, sprain or break wrists and ankles, and suffer more serious injuries. In any event, if you are injured, you may require medical assistance, at your own expense.
Furthermore, Copper Canopy Aerial, LLC, and anyone else who seeks to assist you in learning the art of aerial sling seek safety, but they are not infallible. They might be unaware of a participant’s fitness or abilities. They may give incomplete warnings or instructions, and the equipment being used might malfunction.
In this agreement, you acknowledge that you participate in this activity assuming responsibility of all risks involved. In consideration of the services of Copper Canopy Aerial, LLC and any other participants, volunteers, and all other persons or entities working to teach me aerial sling, I hereby agree to release, indemnify, and discharge Copper Canopy Aerial, LLC, and other said persons on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representatives, and estate as follows:
1. I acknowledge that my participation in an aerial sling lesson entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.
2. I acknowledge that aerial sling and/or going upside down may be contraindicated or may put me at a higher risk of injury if I have certain medical conditions, including, but not limited to, the following: vertigo; inner ear conditions; recent surgery; glaucoma; recent concussion or head injury; epilepsy; recent stroke; Botox (within 24 hours); pregnancy; obesity; propensity for fainting; hiatal hernia; sutures in any part of the body; recent gashes, lacerations, or wounds; medications that can cause dizziness, light-headedness, propensity for fainting, or extreme fatigue; osteoporosis; artificial hip; head cold, flu, or sinusitis; carpal tunnel syndrome; severe arthritis; disc herniation; shoulder pain; severe balance issues; severe muscle spasms; severe neck or back pain; heart disease; hypertension; hypotension.
3. In the event that my physician has recommended any limitations to my physical activity; I have or have experienced any of the conditions listed above; and/or I have or have experienced any conditions not listed above that may or may not affect my ability to be on an aerial sling, I hereby attest that I have informed my physician of the condition(s) and have obtained express consent from my physician to participate in aerial sling lessons.
4. I expressly agree and promise to accept and assume all the risks existing in participating in aerial sling lessons. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks and regardless of whether or not I have disclosed my past, current, or future medical condition(s) to Copper Canopy Aerial, LLC.
5. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Copper Canopy Aerial, LLC, from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of its equipment or facilities.
6. Should Copper Canopy Aerial, LLC, or anyone acting on its behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless of all such fees and costs.
7. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such an injury myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
This form will be kept on file, and this liability waiver agreement will be applied to all future aerial lessons with Copper Canopy Aerial, LLC, or anyone acting on its behalf involving this participant.
By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Copper Canopy Aerial, LLC, or anyone acting on its behalf on the basis of any claim from which I have released them herein.
