SHORT-TERM STAGE POLE RENTAL AGREEMENT

This Short-Term Equipment Rental Agreement (the "Agreement") is entered into on your approved rental date, between yourself (the "Renter") and Keira Beverly (the "Owner") collectively referred to as the "Parties.”

EQUIPMENT DESCRIPTION:

The Owner agrees to rent to the Renter, and the Renter agrees to rent from the Owner, the following equipment (the “Equipment”):

Equipment Name: Lupit pole stage, quick lock, chrome long legs 45mm, integrated silk mount (+optional Soozier Crash Mat)

Description: LUPIT STAGE Chrome is a portable pole dance podium that can be set up in just minutes, so you can use the stage wherever it suits you best: indoors or outdoors. Pink Soozier Crash Mat included in Equipment upon request by Renter.

Rental Period: 24 Hours 

RENTAL TERMS:

2.1 Rental Payment:

The Renter agrees to pay the Owner a rental fee of $185 for the entire rental period specified in Section 1. Payment is due in full at the 48 hours before the beginning of the rental period.

2.2 Security Deposit:

The Renter shall provide a security deposit of $50 once the requested rental period is approved by the Owner. The security deposit will be included in the balance of the total rental fee. If booking is cancelled less than 72 hours before the pickup time, deposit will not be refunded. If booking is rescheduled, more than 72 hours before pickup time, deposit will be transferred to new pickup date. Renter is only allowed two reschedules before the deposit becomes completely non-refundable.

2.3 Late Fees:

If the Renter fails to return the Equipment on the agreed-upon end date and time, a late fee of $25 will be assessed. If the Renter fails to return the Equipment 8 hours or more after the agreed-upon return date and time, the Renter will be charged $185 for another day of rental. The fee will continue to accrue every 24 hours and there is not limit to how many times this fee can be charged.

USE OF EQUIPMENT:

3.1 Care and Maintenance:

The Renter agrees to use the Equipment in a responsible and careful manner. The Renter shall maintain the Equipment in good working condition throughout the rental period.

3.2 Restrictions:

The Renter shall not:

Sublease or transfer the Equipment to any third party without the Owner's prior written consent.

Use the Equipment for any unlawful purpose.

Modify or make any alterations to the Equipment without the Owner's written consent.

Damagethe Equipment.

3.3 Assumption of Risk:

By signed the rental agreement, the Renter acknowledges that pole related activities involve physical movement and may require me them perform exercises that could cause physical injury. They acknowledge there are risks involved, including but not limited to sprains, strains, fractures, and other potential injuries, when utilizing the Equipment without proper training and/or assistance. Lastly, the Renter acknowledges that they are aware of any limitations or health concerns that may affect their ability to utilize the Equipment safely.

Physical Condition:

The Renter certifies that they are in sufficient physical condition and have no medical conditions or injuries that could cause them to be injured while utilizing the Equipment. If the Renter has any doubts about their physical condition, they agree to consult a medical professional before the agreed-upon pickup date and time.

Release of Liability:

In consideration of being allowed to utilize the Equipment provided by Pole Sweets LLC, the Renter hereby releases and discharges the Owner, Pole Sweets LLC, and Wild Aster, including instructors, staff, affiliates, and premises, from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, legal issues, injury, or damage that may be sustained by the Renter or any third-party that utilizes the Equipment while in the Renter’s possession.

PICK UP AND DROP OFF INSTRUCTIONS:

4.1 Renter Pick-Up:

If the Renter chooses to pick up the Equipment from the Owner's location at the beginning of the rental period, no additional fee will be charged. The Owner will meet the Renter at 3425 W Cary St., Richmond, VA 23221 (Wild Aster) at the agreed-upon pickup date and time, or within an hour after the approved time. The Owner reserves the right to charge a fee for late pickups. The Renter agrees to transport the Equipment in a vehicle the provides sufficient space to provide damage to the Equipment.

4.2 Renter Drop-Off:

If the Renter chooses to drop off the Equipment at the Owner's location at the end of the rental period, no additional fee will be charged. The Owner will meet the Renter at 3425 W Cary St., Richmond, VA 23221 (Wild Aster) at the agreed-upon drop-off date and time, or within 8 hours after the approved time. The Owner reserves the right to apply the “Lates Fees” described in Section 2.3 after the 8-hour grace period.

4.3 Owner Drop-Off & Pick-up:

If the Renter requests pick-up and/or drop-off services from the Owner, the Renter will be charged a fee of $2 per mile away from 3425 W Cary St., Richmond, VA 23221 (Wild Aster). This fee is charged per service. The Renter reserves the right to request Owner drop-off service without requesting pick-up service, and vice versa. Owner Drop-Off & Pick-Up may also include assembly and breakdown services if requested. The Owner reserves the right to charge a fee for this optional service.

RETURN POLICY:

5.1 Early Return:

If the Renter wishes to return the Equipment before the end of the agreed rental period, no refund for unused rental hourswill be provided unless an hourly agreement was previously approved by the Owner.

5.2 Late Return:

If the Renter fails to return the Equipment by the specified return date and time, late fees as mentioned in Section 2.3 and Section 4 will apply.

DAMAGE TO EQUIPMENT:

The Renter shall be responsible for any damage to the Equipment that occurs during the rental period. The Renter agrees to pay for the repair or replacement of the Equipment as necessary to restore it to its original condition. If any repairs or replacements are needed, the Renter will be charged the actual cost of such repairs or replacements.

TERMINATION:

Either party may terminate this Agreement with written notice to the other party. In the event of early termination, the Renter shall be responsible for applicable fees.

GOVERNING LAW:

This Agreement shall be governed by and construed in accordance with the laws of the state of Virginia.

ENTIRE AGREEMENT:

This Agreement constitutes the entire agreement between the Parties, and supersedes all prior and contemporaneous agreements, representations, and understandings.
