ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM

IMPORTANT: This Accident Waiver and Release of Liability Form (“Release Form”) is a legal

document, please read carefully before signing.

In consideration of participating in this Sports Camp Program (the “Program”), I the undersigned, am

either the Participant or the parent and/or legal guardian (“Parent/Guardian”) of the minor Participant.

I represent that Participant does not have any medical conditions that would prevent participation in the

Program, and Participant is in good health and in proper physical condition to participate in the

Program. I understand that the Program’s activities are vigorous sporting activities. I am familiar with

the activities which take place in this Program. I freely and voluntarily allow Participant in the Program.

I understand that participation in the Program can include foreseeable and unforeseeable risks and

other hazardous activities inherent in the Program, which may expose the Participant to risk of serious

bodily injury, including but not limited to permanent disability, paralysis, or even death. I fully accept

such risks and all responsibilities for losses, cost, and damages incurred from or arising out of

participation in the Program activities.

I hereby agree to release, waive, covenant not to sue, indemnify and hold harmless the Program and

the Program’s owners, officers, directors, agents, administrators, employees, volunteers, and any

owners or lessors of the premises on which the Program takes place (collectively the “Releasees”),

from any and all liability, claims, demands, and causes of action whatsoever arising out of or related to

any loss, damage, or injury, including death, that may be sustained by Participant or loss or damage to

any property belonging to Participant arising out of or related to participation in the Program or caused,

or alleged to be caused, in whole or in part by the negligence of the Releasees.

I agree that the site of any lawsuit arising out of or related to participation in the Program shall be Utah

and that this Release Form will be governed by and construed in accordance with the laws of the state

of Utah, without application of any principles of choice of law.

I acknowledge and agree that Participant or Parent/Guardian will pay any attorney fees or costs

incurred by Releasees in enforcing this Agreement.

If any portion of this Agreement is held to be invalid by a court of law, then it is agreed and intended

that all the remainder shall, notwithstanding, continue in full force and effect.

I have read and understand the contents of this Release Form. I freely and voluntarily agree to this

release of liability which I understand to be a complete and unconditional release of all liability to the

greatest extent allowed by the law.
