By signing this agreement, you (for yourself, your successors, next of kin, and anyone acting on your behalf, altogether, “You” or “Participant”) represent and warrant that you are legally, physically, and mentally able to fully participate in the services provided by Aiyana Entertainment LLC (“Aiyana”), including but not limited to the consumption of alcohol, consumption of liquids in an acrylic tube, splashing water, and physical contact (e.g., without limitation, slapping) (all the foregoing, the “Services”). You recognize and acknowledge that participation in the Services is both voluntary and an inherently dangerous which exposes you to risk of serious bodily injury including, but not limited to soreness, swelling, burning, deformity, nerve palsy, bruising, bleeding, lacerations to the ears, eyes, nose, lips or any facial trauma. widening of the distance between the eye, changes in vision, loss of vision or the movement of the eye. Changes in or loss of hearing. Concussion and any and all other potential injuries that may not be listed as well as death which may be caused by your actions, inactions, or negligence or the actions, inactions or negligence of others, including but not limited to Aiyana (for itself and its employees, agents, and contractors) including bodily harm, ingestion of alcoholic beverages, exposure to viruses and bacteria, pandemics, or other pathogens. You understand that the inherent risks and dangers associated with participation in the services may never be eliminated completely. Risks include, but are not limited to, accidents, property loss or damage, serious personal and bodily injury, mental injury, pain and suffering, death, and severe social and economic losses, and emotional distress, and could include risks that are not known or reasonably foreseeable. You, for yourself, your successors, next of kin, and anyone acting on your behalf, waive any and all specific notice of the existence of risks, understand and have considered and evaluated the nature, scope, and extent of the risks involved, before, during and after, from participation in the services, and elects to voluntarily enter into this Agreement and to voluntarily and freely assume these risks. Participant understands that in consideration and exchange for, and as a condition of my participation in the services, I knowingly and freely release and indemnify Aiyana and Aiyana’s owners, employees, volunteers, sponsors, advertisers, parent organizations, subsidiaries, affiliates, dbas, insurers, facility owners of the premises, promoters, vendors, service providers, and related independent contractor from all responsibility to me, my estate, heirs, executors, personal representatives, insurers, successors and assigns, for anything that occurs during my participation in the services.
